Terms of Service

The terms for using IMABIT and purchasing our digital publications and software.
1. Who we are and these terms
IMABIT offers an English-language digital storefront to customers in the United States and internationally. These terms govern site use, accounts, and purchases from IMABIT. Contact us at support@imabit.com.
Review these terms before creating an account or placing an order. Where we request agreement, you must accept them to complete the relevant transaction. You must have legal capacity to enter the transaction; if acting for an organization, you must have its authority. Nothing here limits mandatory consumer rights.
The Privacy Policy explains how we handle personal information. The Refund Policy explains our refund procedure and is part of the purchase terms.
2. Products and digital delivery
Our products include technical ebooks in PDF or EPUB format, guides, and software products or licenses. The product description identifies the formats, features, compatibility requirements, and any specified license duration or support entitlement. No physical item is shipped unless expressly stated.
Ebooks and digital media become available for download immediately after payment completion. Software downloads and license access follow the product and order instructions. You are responsible for providing a working email address and compatible equipment; we remain responsible for delivering the product as described. Report missing or inaccessible purchases to support.
Updates, future editions, ongoing services, and support are included only to the extent stated in the product offer or required by law. These terms do not reduce any update or conformity obligations imposed by applicable law.
3. Your license
After payment, IMABIT grants you an individual, non-exclusive, non-transferable, revocable license to use the purchased product for personal, educational, or internal professional purposes, subject to these terms and any product-specific license disclosed before purchase. You receive permission to use the content, not ownership of its intellectual property.
Individual use permits reading, running software, and keeping reasonable backup copies for your own use. Educational use does not permit distributing copies to a class, and internal professional use does not grant a team-wide license. Contact us for additional users or broader permissions.
Revocation is limited to a material license breach, fraud, a refunded purchase, or a legal requirement; it is not an unrestricted right to withdraw a paid license. Where appropriate and legally required, we provide notice and an opportunity to remedy a breach. Immediate action may be taken for fraud or an active security threat.
Separately identified third-party or open-source components retain their own licenses. Those licenses and permissions expressly granted with code examples control where they conflict with these general restrictions.
4. Use restrictions
Unless we give prior written consent, or a separate applicable license or mandatory law permits it, you must not:
- Reproduce the product beyond your licensed use or remove ownership, copyright, or license notices.
- Resell, sublicense, commercially distribute, share files or license credentials, or publicly host purchased publications or software.
- Use book text or accompanying code to train or fine-tune AI models, or supply it to a model-training dataset.
- Circumvent access controls or help others obtain unauthorized access to paid products.
Request permissions at support@imabit.com. These restrictions do not remove statutory exceptions, including any applicable fair-use or non-waivable software rights.
5. Prices, payment, and taxes
Prices and transactions are in US dollars (USD). Review the final total, including any taxes or charges we collect, before confirming payment. Your bank or payment provider may apply currency conversion or its own fees if your account uses another currency.
Payment is handled by the third-party gateway offered at checkout. You must be authorized to use the payment method and provide accurate billing information. We may reject or suspend a transaction reasonably suspected of fraud, subject to applicable law and any refund due.
We collect and remit taxes where legally required. You are responsible for any applicable local, state, or regional sales or use taxes, cross-border taxes, or import charges that we are not required to collect. This does not transfer our own statutory tax obligations to you. Digital-only delivery does not itself imply a physical customs shipment.
6. Accounts and acceptable use
Provide accurate account information and keep it current. Keep your password confidential, do not share your account, and promptly notify support@imabit.com of suspected unauthorized access. You are responsible for activity you authorize; reporting misuse does not automatically make you liable for every unauthorized transaction.
Do not engage in fraud, impersonation, abusive scraping, unauthorized vulnerability scanning or system probing, attempts to bypass authentication, malware distribution, or activity that disrupts the site or other users. Security testing requires prior written authorization.
We may immediately suspend or terminate accounts or access for fraudulent activity, abusive scraping, unauthorized system probing, or an active threat. For other material breaches, notice and an opportunity to remedy are provided where appropriate or required. Contact support if you believe a restriction was applied in error. Termination does not remove accrued statutory rights, refund obligations, or access to dispute procedures.
7. Refunds and withdrawal
Our Refund Policy provides a 14-day request window for eligible defective, inaccessible, undelivered, or accidental duplicate purchases. Change-of-mind refunds are generally restricted after access or download, subject to mandatory rights.
Where EU digital-content withdrawal rules apply, loss of the withdrawal right requires delivery to begin following your prior express consent and acknowledgment of that loss, together with the required durable-medium confirmation. These terms alone do not supply that consent. Rights concerning defective or nonconforming content remain unaffected.
8. Warranties and informational use
To the fullest extent permitted by applicable law, the site, digital informational publications, and software tools are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not promise uninterrupted availability, error-free operation, or a particular professional, educational, or financial result.
Technical explanations and examples are educational information. Evaluate suitability, test code and tools in an appropriate environment, and keep backups before applying them to important systems.
These disclaimers do not override express product descriptions or promises, statutory conformity requirements, or warranties and remedies that cannot lawfully be excluded. Some jurisdictions do not allow certain warranty exclusions; those exclusions do not apply to you where prohibited.
9. Limitation of liability
To the extent permitted by applicable law, IMABIT’s total aggregate liability arising from a specific purchased product is limited to the amount you paid for that product. To that same extent, IMABIT is not liable for indirect or consequential losses, including lost profits, business interruption, or lost data.
These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited. They do not restrict mandatory refunds or consumer remedies. If a limitation is prohibited in your jurisdiction, the applicable legal protection takes priority.
10. Governing law and disputes
These terms and commercial transactions are governed by the applicable federal laws of Mexico, including Mexican commercial law, subject to any mandatory consumer protections that apply in your jurisdiction. This choice does not deprive you of protections that applicable law makes non-waivable.
Please first contact support@imabit.com with the order number, issue, and requested resolution so we can attempt a good-faith informal resolution. This request does not delay filing deadlines or prevent urgent relief, a payment dispute, or a complaint to a competent consumer authority.
If informal resolution fails, disputes may be brought before the competent courts in Mexico, subject to any mandatory right you have to use the courts or consumer procedures in your own jurisdiction. Arbitration is available only if both parties separately agree and applicable law permits it; these terms do not impose mandatory arbitration.
11. Changes and contact
We publish changes on this page and update the date above. Updated purchase terms apply to future transactions; they do not retroactively reduce the license or rights attached to an existing purchase. Material changes affecting ongoing services will be communicated with notice and any consent required by law. If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted.
